New Hampshire’s Whistleblower Protection Act and Common Law Protections

New Hampshire’s Whistleblower Protection Act and common law protections work in tandem to protect whistleblowers and hold employers accountable for retaliation. Under these laws, an employer may not retaliate against an employee who reports what he reasonably believes is a violation of the law. An employer is also prohibited from retaliating against an employee because the employee, acting in good faith, refused to participate in illegal activity or refused to follow a directive to do something illegal. Furthermore, an employer may not retaliate against an employee who, in good faith, participates in an investigation, hearing, or inquiry by a governmental entity to determine whether the employer violated a law.
